  You are hereby requested to read all these conditions carefully, as you shall be bound by them.  
     
  Your contract: When a booking is accepted by us, it constitutes a contract between you and the Travel Agent. All bookings are taken on the basis that you accept these terms and conditions. Travel Agent in this case is Bharath International Travels, Equino Fun Holidays / Odyssey Travels / Travels & Rentals / Trail Blazers / Saltours International. The contract and the disputes, if any, will be subject to the jurisdiction of Mumbai / Kolkata / Pune / Bangalore courts only.  
     
  Tour Operator Terms & Conditions: The ground arrangements for ‘Landmark Journeys’ are made by Cosmos and therefore all Cosmos’ standard terms and conditions are applicable to the land portion of the tour in addition to the terms and conditions listed below. These are available on request and on www.cosmosvacations.in. It is understood that you have read and accepted the terms and conditions before booking the vacation.  
     
  Validity:  Itineraries, resorts, hotels and prices are subject to change any time without prior notice.  
     
  Prices: Tour prices are calculated on exchange rates as in November 2010. Any increase in air/ cruise fare, fuel or exchange rates, leading to an increase in the surface transportation and land arrangements prior to the date of departure will have to be borne by you. All prices including air, visa, insurance, tour are quoted based on the best available prices and information at the time the brochure is printed. Airfares are not guaranteed till they are booked and paid for. All prices are subject to change without prior notice. Costing for the tour is based on all start and end points as specified in the itinerary.  
     
  Itinerary accuracy: The information given in the itinerary is as accurate as possible. However, please note that the itinerary is prepared months in advance and circumstances can change due to any events beyond our control. Major road works/ blocks may necessitate route changes; Indian restaurant, if included, may close or change management. All of this may cause us to make changes in the itinerary and / or meal arrangements. Changes may become necessary for your safety and for maximizing on your experience. Where we may know of changes sufficiently in advance, we will notify you. Otherwise, the Tour Director or local representative will inform you of the changes while on the tour.  
     
  Booking and payment: A non–refundable and interest–free deposit of US$250 + Rs.10,000/- per person is required to be paid by you at the time of booking /registration. Full payment is required at least 45 days prior to the date of departure to hold confirmed services in your favor.  
     
  Airfares: Your Travel Agent will calculate the airfare for your vacation separately based on departure and arrival to your start/end city, unless specified otherwise at the time of booking. You may choose the airline most convenient for you.  
     
  Visa: You are required to apply for your own visa with the assistance and guidance of the Travel Agent. It is your responsibility to provide all the required documents for processing the visa in a timely manner. In the event the visa application made by you or the Travel Agent on your behalf is rejected by the consulate due to any reason whatsoever, the Travel Agent is not be liable for the eventuality. Booking amount will be forfeited and no claims entertained in this regard.  
     
  Children: Landmark Journeys at Europe offers special child prices for children aged from 4 to 8 years without extra bed, 4 to 11 years with extra bed and a 10% discount for travelers from 12 to 17 years of age on the land tour price. Landmark Vacations at North America offer special child prices for children under 12 years and a 10% discount for travelers for 12 to 17 years of age. The child prices are clearly indicated for every itinerary. Costs for airfare, visa, insurance etc. for children are available on request. We find that children below 4 years of age are too young to enjoy coach touring and as such we discourage such young children coming on the tours. Please contact us if you have a child below 4 years of age on the tour.  
     
  Travel Insurance: It is necessary that you acquire adequate insurance to meet medical emergencies, loss of baggage, passports etc. Travel Insurance does not cover cancellation against Landmark journeys land tour and it is recommended that you purchase a Trip Protection offered by Cosmos to protect against this cancellation.  
     
  On–tour behavior: All travelers are required to behave in a manner that is conducive to group travel. We reserve the right to remove any tour participant causing distress or annoyance to co–travelers or who may endanger or damage property of any supplier or to other travelling companions, without assigning any reason whatsoever. No refund for unused services is possible in such cases.  
     
  Accommodations: As such hotel rooms in Europe are often small and can rarely accommodate more than 3 persons. If you are travelling with more than one child, you will be staying in 2 rooms. At times these may not be inter–connecting rooms or even on the same floor. Triple rooms are usually the same size as twin rooms and an additional extra bed or a roll away bed is provided for the third person. Accommodation in the hotels mentioned in the itineraries is subject to change.  
     
  Cancellation: In the event of the cancellation of a tour, the following are payable in addition to the visa fees, insurance charges, flight costs etc. already incurred. Total price does not include any discounts, promotions, or special incentives.

Standard Cancellation Fees escorted and independent vacations:
• 45–22 days prior to commencement of services: 20% of total price plus Trip Protection payments
• 21–8 days prior to commencement of services: 30% of total price plus Trip Protection payments
• 7–1 days prior to commencement of services: 50% of total price plus Trip Protection payments
• On departure day and later: 100% of total price plus Trip Protection payments

The above is valid upon the presentation of the original receipt only. Rebooking one tour to another will be treated as a cancellation. All cancellations must be received in writing and signed by the tour participant, who made the booking. In case you have to withdraw from a tour after it has begun for reason such as illness, a medical certificate and other documents are necessary in support of any insurance claim, if applicable.

The Travel Agent, under no circumstances, will be liable for any loss of baggage, goods, air tickets, passport, cash, traveller’s cheques, or any other travel document or item owned by the passenger while on tour, whatever the cause..

The Travel Agent and Cosmos reserve the right to cancel or reschedule any vacation departure for any reason, including insufficient demand. If a vacation is canceled prior to departure, the Travel Agent’s only responsibility will be to refund the amount received for the reservation. The Travel Agent will try to rebook on other available Cosmos vacations with different departure date, or on a similar vacation. The Travel Agent cannot assume responsibility for any additional costs or any fees relating to the vacation for travel arrangements not made through the Travel Agent.
 
     
  Refund: The Travel Agent and Cosmos reserves the right to determine the quantum of refund payable in case of cancellation or amendment of a tour due to force majeure or vis majeure. Such refund would be based on various factors like the number of participants; the cancellation policies of suppliers like hoteliers, coach operators, etc. And the decision of the company on the quantum of refund shall be final.

There shall be no refund for partially utilized flights or ground arrangements. There shall be no refund if you do not or cannot utilize any service included in the tour cost of the tour like meals, rooms, excursions, etc. Nor can any refund be made for lost, mislaid or destroyed travel tickets or vouchers. There shall be no refund if you fail to join the group at the commencement to the tour, or join the group late or leave the group before culmination of the tour.

All complaints/claims must reach the Travel Agents office in writing within 30 days after the tour concludes. Otherwise, the same will not be entertained.
Refunds (if any) for amendments and / or cancellation will be paid directly to tour participants by the Travel Agent. It can take at least 45 days to process such refunds.

Even in case of a tour for which the payment was made in foreign currency with or without part payment in Indian Rupees, the said refund shall be made only in Indian rupees at the prevailing rate on date of refund as per rules and regulations set forth by RBI.
 
     
  Gratuities and Tips: Tips are included for the Tour Director and the driver. Porterage for one bag is also included. For Local Guides, your Tour Director will be pleased to advise you the recommended amounts.  
     
  Important:
  • Optional tours are at your discretion. Please read the travel documents in advance to enable you to budget for these.
  • The Travel Agent is not responsible for any damages / loss accrued due to acts or negligence of any air carrier, hotel, coach, company or attraction.
  • You are required to check all documents, visas, air tickets, insurances etc.
  • The Travel Agent reserves the right to alter / vary or withdraw any facility it has advertised or published in the large interest of the group or due to unavoidable circumstance. In such a case, the Travel Agent is not liable to pay any compensation.
 
     
  Liability: Travel Agents are travel organizers only. We do not control or operate any airline, neither do we own or control any shipping company, coach company, hotel, transport, or any other facility or service mentioned in this itinerary. We take care in selecting appropriate options to complete your vacation, but because we only select and inspect them and have no other control in their running, we cannot be held responsible for any injury, death, loss or damage, or deficiency in services, caused by the act or default of management or employees of an independent contractor arising outside our normal selection and inspection process. The Travel Agent shall not accept any liability or responsibility for any damage, loss, injury, accident, death, delay, breakdown or irregularity, which may occur while carrying out the tour arrangements. In the unlikely event of a traveler falling ill or suffering any accident during the journey, all hospital expenses, doctor fees, repatriation expenses, any other charges incurred as a direct or indirect result of your illness / accident are your responsibility. The Travel Agent reserves the right to claim any additional expenses due to delay or changes in train, airplane, bus, ship or other service, weather conditions, strikes, war, quarantine, any other cause whatsoever and all such loss or expenses must be borne by you.
